The person arrested will be given an opportunity to present itself in the court within 24 hours from legal warrant send to them.<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><b>When can a person be arrested under section 132?<\/b><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">1- Supplies goods\/services without any valid tax invoice or issuing a false bill(generating black money)<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">2- Refraining any officials in discharge his\/her duty;<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">3- Generation of taxable invoice without supplying the necessary goods\/services<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">4- Generating false information for registration particulars;<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">5- Collects any GST from the recipient but fails to provide it to the government within the period of 3 months<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">6- Not getting GST Registration Online even though the entity is liable to pay tax\u00a0<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">7-Non or under deduction of tax;<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">8- Adding tax while providing service or goods to the customers but failure to provide the same to the government<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">9- Disposing \/tampering goods detained under the Act;<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">10- Obtaining tax credit without<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><b>Original receipt of goods and services;<\/b><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">&#8211; Transporting goods without any prescribed documents;<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">&#8211; Supplying\/transporting\/storing any goods banned by the government;<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">&#8211; Illegally tampering\/destroying evidence;<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">&#8211; Generating improper\/false information of the tax file or creating fake documents with a motive to skip the payment of tax.<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">&#8211; Suppressing profits leading to none\/underpayment of tax;<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">&#8211; Purposely failed to maintain a proper file of tax\/documents in a specific format as guided in the act of GST.<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">&#8211; Purposely failed to keep the accounts\/documents secure for a particular period required.<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">If the commissioner of Central or state GST feels any hint of violation of law by a taxable person then he or she might be arrested by any registered officer. Under this case, the arrested person can get bail.<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><b>Penalty charged for violating section 132<\/b><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">If a taxable person has committed any of the above offense then he\/she will be bound to give a minimum penalty of Rs. 10,000 which can be extended to Rs. 1,00,000 depending on the amount of unpaid tax.<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><b>Collection of evidence\u00a0<\/b><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\"><br \/><\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">An <b>SGST\/CGST<\/b> officer can question anyone to provide evidence.<\/font><\/div>\n<div><font size=\"4\" face=\"Georgia\" color=\"#330033\">The person questioned, has to attend on his\/\/her own or through an advocate.
