There are various procedures for registering a Non-Governmental Organization/Non-Profit Organization (NGO). The registration of the NGO as a Trust, Society, Non-Profit Company or any other procedure is done under the Trust Act, Societies Act, Companies Act or any other Act or Law which has to be followed.
NGO i.e. voluntary organization can be registered under various Acts under which trust, society and non-profit company is section 8. There are various process and requirements to register an NGO:
What are the various process to register an NGO?
First of all, the name of the NGO has to be decided for registration. Any name can run in the trust, but the name of the new NGO cannot be decided by matching the old registered NGO as per the prescribed scope of work in the society and non-profit company. The name of the NGO should not be resemblance to any government name or government authority or project and the name should also be outside the purview of the provisions of the Emblem Act.
What are the objectives of an NGO?
The objectives of the NGO should be fixed, which is a major part of it. Depending on the objectives, the NGO can do social service and social welfare work in various required areas. The specific objectives and specific issues on which the Institute wants to work should preferably be included in the Memorandum at the time of registration. Apart from these, other general social welfare and social development related work plans also have to be included in the objectives.
Important points for NGO registration:
- Memorandum has to be prepared for registration. For trust, it is called trust deed. In society it is called Memorandum of Association and Article of Association.
- More than one member is required to register any social institution. There may be two or more members for valid registration under the provision of any Act.
- There is a process of registration trust under which the NGO is registered. At least two members are required in the trust, three members should be kept so that it remains reasonable for the time to come. The company also needs at least two directors. At least 7 members are required to register an NGO in the society.
- There is no limit on the maximum number of members in any registration process. The trustees of the trust and the directors of the company are known as members. In the registration process in the society, the executive has to be decided by fixing the posts of ordinary members, whereas in the trust deed of the trust, it is not necessary to mention the names of the executive members and their positions.
- When the society and trust are registered through whom the consultant guides for the formation and operation of the managing executive before and after. After the registration process in the trust, the managing executive body of the trust is constituted by passing a resolution, under whose consultancy service the procedure can be explained.
